The California Highway Patrol got a phone call at about 10:30 p.m. on March 12 about an accident that took place on Highway 99. A Ford Mustang had gone down an embankment on the southbound East Avenue on-ramp and had hit a tree. This resulted in a homeowner and a person driving a Kia to check on the driver of the Mustang.
Minutes after this occurred, a 24-year-old woman driving a Toyota Tacoma hit the Kia from behind, went down the embankment itself and slammed into the Mustang. The driver of the Tacoma was charged with felony DUI after being taken into custody at the scene of the accident. Meanwhile, the driver of the Mustang suffered serious injuries.
Those who are hurt in an accident caused by a drunk or impaired driver may experience significant injuries. These injuries may make it difficult or impossible to return to work, school or other activities. It may also make it harder to sleep, interact with loved ones or live the same general quality of life as before the crash happened. Those who are victims of motor vehicle accidents may wish to hire an attorney and pursue compensation from the driver who caused the crash.
As a general rule, those who drive while impaired are considered to be acting in a negligent manner. Therefore, an attorney may obtain evidence that a person was impaired when an accident occurred such as toxicology reports or witness testimony. An attorney may also use statements given by the driver involved in the accident as well. Compensation may be obtained in a negotiated settlement outside of court or after a formal jury trial.
